Bauer’s bill to close loophole in child seduction statute signed into law
House Enrolled Act 1228, a bill to better prosecute child seduction, has been signed into law by Gov. Eric Holcomb. Authored by Rep. Maureen Bauer (D-South Bend), the legislation will close a loophole in Indiana law to ensure acts of child seduction committed by youth sports coaches are adequately prosecuted. HEA 1228 passed out of the House of Representatives 94-0 and the Senate 42-0.
HEA 1228 adds acts of child seduction committed by youth sports organization coaches, such as athletic clubs and travel leagues, into the current child seduction criminal statute. The current statute only applies to childcare workers who are employed by school corporations, charter schools, nonpublic schools or special education cooperatives, and who are in a position of trust or power over a child.
“Closing this gap in Indiana law ensures that youth sports coaches are held to the same standard as school coaches. By signing this bill into law, Gov. Holcomb will be taking real action to protect all youth athletes, no matter where they decide to play,” Bauer said. “Coaches are in a position of trust and authority, and provide care and instruction to a child. Most abuse happens within a child's circle of trust. This bill provides a long-overdue change needed to strengthen protections for young athletes, and holds adults who abuse this position of power accountable.
